Terms of Service

These Terms govern your use of the Conga app and any related services provided by Conga Media Limited. By creating an account or using Conga, you agree to be bound by them.

Welcome to Conga. These Terms of Service (“Terms”) govern your use of the Conga app and any related services provided by Conga Media Limited (“Conga”, “we”, “us”, “our”). By creating an account or using Conga, you agree to be bound by these Terms. Please read them carefully.

Our Privacy Policy forms part of these Terms and explains how we handle your personal data.

1.Who We Are

Conga is operated by Conga Media Limited, a company registered in England and Wales (Company Number 13361185). If you have any questions about these Terms, contact us at legal@congamedia.com.

2.Eligibility

Conga is strictly for users aged 18 and over. By creating an account, you confirm that you are at least 18 years old. If we suspect that a user is under 18, we will suspend the account pending review and permanently remove it if the user is confirmed to be underage.

You must also have the legal capacity to enter into a binding contract under the laws of your country of residence.

By creating an account, you also confirm that you have not previously been removed from Conga unless you have our express written permission to rejoin.

3.Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at report@congamedia.com if you believe your account has been accessed without your authorisation.

You may only create one account. Creating multiple accounts to circumvent a suspension or ban is prohibited.

Some profile information, such as your bio, is optional. You are responsible for ensuring that any information you provide is accurate and not misleading.

4.The Service

Conga is a location-based social platform that helps you discover, join, and share real-world experiences. We grant you a personal, non-transferable, non-exclusive, revocable licence to use the Conga app, subject to these Terms. This licence covers your own personal use, and legitimate business use where you are creating or promoting a Conga as a business, venue, or Conga Creator. You must not use the app to build a competing product, scrape or resell access to it, or use it for any other unauthorised commercial purpose.

Conga is a technology platform that allows users, businesses, venues and Conga Creators to create, share and discover real-world gatherings and activities (“Congas”). A user who creates, hosts, or promotes a Conga is referred to in these Terms as a “Conga Creator.” Congas can be created with different visibility settings:

  • Public — visible to all users via the map and discovery features;
  • Private — visible only to users directly invited by the Conga Creator; or
  • Private (shareable) — visible only to invited users, but those users may in turn invite others, meaning attendance may extend beyond who the Conga Creator originally invited.

Visibility settings may affect which features are available, including under paid subscription tiers.

The following terms are also used throughout these Terms and within the app:

  • Scheduling window: the maximum period of time in advance that a Conga Creator may schedule a Conga. The length of this window may vary by subscription tier.
  • Fans: users may choose to follow a Conga Creator to receive updates about that Conga Creator’s public Congas. Following a Conga Creator does not grant access to that Conga Creator’s private or private (shareable) Congas.
  • Ticket link: an optional field allowing a Conga Creator to add a link to a third-party website where tickets or admission to a Conga may be purchased. Conga does not process, verify, or guarantee any transaction made through a ticket link, and is not responsible for ticket fulfilment, refunds, or the accuracy of information on the linked site — see Section 18 (Third-Party Services).
  • Admission information: an optional field allowing a Conga Creator to state entry requirements for a Conga (for example, age restrictions, ID requirements, or a door charge). This information is supplied by the Conga Creator and is not verified by Conga — see Section 8.

We do not guarantee that the service will be available at all times or without interruption. We may suspend, withdraw, or restrict access to all or part of the service for operational, security, or maintenance reasons, and will endeavour to give reasonable notice where possible.

5.What Conga Is (and Is Not)

Unless we expressly state that a specific Conga is organised by Conga Media Limited, we do not organise, host, manage, supervise, control or operate any Conga displayed or shared through the platform.

The fact that a Conga appears on the platform does not mean that we:

  • organise or operate the Conga;
  • control the venue;
  • supervise attendees;
  • provide security or crowd management;
  • check fire, health and safety, or accessibility arrangements;
  • verify licences, insurance, or regulatory approvals;
  • guarantee that the Conga will take place; or
  • guarantee that the Conga is safe, lawful, suitable, or accurately described.

Displaying, ranking, or recommending a Conga does not mean we endorse it, its Conga Creator, its venue, or its attendees.

6.User Content

What you can post: Conga allows you to post photos, videos, comments, messages, and other content (“User Content”) subject to these Terms and our Community Guidelines.

You own your content: You retain ownership of User Content you post on Conga.

The licence you grant us: By posting User Content on Conga, you grant Conga a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute your content for the purposes of operating, providing, improving, promoting, and marketing Conga — including, where your content is public, featuring it in Conga’s own marketing materials such as social media, our website, or app store listings. This licence ends when you delete the relevant User Content or close your account, except to the extent we reasonably need to retain copies for legal, regulatory, safety, security, or backup purposes, consistent with our Privacy Policy.

Your responsibilities: You are solely responsible for the content you post. You confirm that:

  • You have the right to post the content and to grant the licence above;
  • Your content does not infringe the intellectual property, privacy, or other rights of any third party; and
  • Your content complies with these Terms and all applicable laws.

You can delete individual pieces of content at any time. Deleted content will cease to be publicly visible through the service, although copies may be retained in the limited circumstances described above.

We do not use your User Content to train artificial intelligence or machine learning models.

7.Conga Creators

If you create, host, or promote a Conga (a “Conga Creator”), you are solely responsible for:

  • planning, managing and operating the Conga;
  • the safety and welfare of attendees;
  • ensuring the venue is suitable and legally permitted to host the Conga;
  • obtaining all necessary licences, permissions, consents and insurance;
  • complying with fire safety, health and safety, capacity, security, food safety, alcohol licensing and other applicable laws;
  • ensuring your Conga description is complete, current and accurate;
  • communicating cancellations, changes and safety information to attendees;
  • making suitable arrangements for accessibility;
  • the conduct of your staff, contractors, performers and representatives; and
  • setting and managing capacity, controlling admissions, monitoring crowd conditions, and complying with venue and licensing limits.

By creating a Conga you warrant that you have the legal right and authority to create and publicise it. This applies equally to informal or spontaneous gatherings created by individual users, not only commercial Congas — you are responsible for ensuring you are entitled to use the relevant location and that the gathering is lawful and appropriately managed, even where it spreads beyond the people you originally invited. We may limit, restrict, or close a Conga where its scale, location, or nature creates a potential legal or safety concern. Attendance numbers, map activity, and engagement metrics are indicative only and must not be relied on as an accurate crowd count or safety-management tool.

8.Conga Information; Verification; and Mapping Data

Conga details (including dates, times, locations, ticket availability, pricing, capacity, accessibility, age restrictions, licensing, security, and health and safety arrangements) are typically supplied by Conga Creators, venues, users, or other third parties. We do not ordinarily independently verify this information, and it may change at short notice — check important details directly with the Conga Creator or venue before travelling to or attending any Conga.

Conga may display badges on a user’s profile to indicate their subscription tier (for example, Creator or Partner). These badges are cosmetic and reflect subscription status only. They do not mean we have audited the Conga Creator, inspected the venue, verified licences, approved safety arrangements, or guaranteed any Conga associated with that user, and the same applies to any ranking or preferred placement.

Location and mapping data on Conga may be approximate, delayed, incomplete, or affected by technical limitations. Do not rely solely on the map for emergency navigation, access routes, venue entrances, evacuation, or to determine whether an area is safe. Conga Creators are responsible for providing accurate location information and correcting errors.

Photographs, videos, reactions, and other content generated by users in connection with a Conga are supplied by users and do not represent our views. We do not guarantee that such content is accurate, complete, current, authentic, lawful, or representative of the whole Conga.

9.Interaction Between Users

Conga is not a party to and has no control over any in-person meeting, event, or interaction arranged between users. You acknowledge that meeting people through Conga, like meeting anyone new, carries inherent personal risk, and that Conga does not investigate, endorse, or vouch for any user. To the fullest extent permitted by English law, you release Conga Media Limited, its officers, employees, and agents from any claim, demand, or damages arising out of your interactions with other users, whether online or in person. This release does not affect any statutory rights that cannot be excluded under English law, including our liability for death or personal injury caused by our negligence, or for fraud.

You are responsible for deciding whether to attend any Conga and for exercising your own judgement — including as to the legitimacy of the Conga Creator, the suitability of the venue, whether the Conga has changed or been cancelled, travel arrangements, local conditions, personal safety, weather, crowd levels, alcohol- or drug-related risks, meeting people you do not know, and any medical, accessibility, or other personal requirements. Follow the instructions of Conga Creators, venue staff, emergency services, and public authorities.

You can block another user, or leave a Conga, at any time and without needing to give a reason.

Conga is not an emergency service and should not be relied on for emergency warnings, urgent assistance, or real-time safety instructions. If you are in immediate danger, contact emergency services or venue personnel directly. An in-app report is not a substitute for contacting emergency services, may not be reviewed immediately, and does not mean we have accepted responsibility for investigating or managing an incident.

To the fullest extent permitted by English law, we are not responsible for injury, loss, or damage arising from your attendance at a Conga that we did not ourselves organise, where that injury, loss, or damage was not caused by us. This is subject to the limitations on our liability set out in Section 17.

10.Prohibited Conduct

You must not use Conga to:

  • Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene;
  • Harass, bully, intimidate, or stalk other users;
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity;
  • Post content that infringes the intellectual property rights of others;
  • Distribute spam, unsolicited messages, or automated content;
  • Attempt to gain unauthorised access to Conga’s systems or another user’s account;
  • Use Conga for any unauthorised commercial purpose, including scraping, reselling access to the service, or using Conga to build or promote a competing service;
  • Falsify, spoof, or otherwise manipulate your location or proximity data, including to post content or gain access to features intended only for users physically present at a Conga;
  • Create or post a Conga that does not genuinely exist, or that is designed to mislead users into travelling to a location under false pretences;
  • Use Conga to track, locate, or monitor a specific individual’s movements or whereabouts without their knowledge or consent;
  • Use Conga to facilitate fraud, scams, the sale of illegal goods or services, or sexual exploitation or trafficking; or
  • Post content that violates any applicable law or regulation.

11.Indemnification by the User

You agree to indemnify and hold Conga Media Limited harmless against any claims, losses, liabilities, and reasonable costs (including legal fees) arising from your unlawful conduct, your violation of the rights of a third party, or your negligent, reckless, or deliberate breach of these Terms or misuse of the service. Conga will notify you promptly of any such claim and you agree to cooperate with our reasonable requests in defending it.

12.No Verification of Users

Conga does not conduct criminal record, identity, or background checks on users, and does not verify the truth of anything a user tells you about themselves. We make no representation about any user’s identity, intentions, or conduct. You are solely responsible for exercising judgement and taking reasonable precautions when communicating with or meeting other users, whether or not Conga has provided safety guidance.

13.Moderation and Enforcement

Content moderation on Conga is conducted through human review. We may also use automated tools to help identify or surface content that requires review. We reserve the right — but are not obligated — to review, remove, or restrict access to any User Content that we reasonably believe violates these Terms or applicable law.

We may suspend or permanently terminate accounts where users breach these Terms, engage in repeated violations, or pose a risk to the safety, integrity, or security of the platform, our users, or the wider community. This includes circumstances where we reasonably believe a user poses a danger to others — for example, where they have been convicted of a serious violent or sexual offence, or are required to register on a sex offender register.

If you believe your content was removed, or your account restricted or suspended, in error, you may appeal by contacting us at appeal@congamedia.com within 30 days, explaining why you believe the action was incorrect. We will review your appeal and respond with our decision. You can also report content or conduct by another user that you believe breaches these Terms using the in-app “Report” function or by emailing report@congamedia.com.

You can report a Conga or related content that you believe is unlawful, unsafe, or seriously misleading — for example, illegal or unlicensed gatherings, incitement to violence, dangerous challenges, unauthorised use of private property, fraudulent ticketed events, material misrepresentation of a venue or Conga Creator, or a Conga that creates an obvious and serious risk to public safety. We do not review Congas before they appear on the platform. We rely on user reports and our moderation processes described above to identify and address content or conduct that breaches these Terms.

We may, at our discretion, review reports, request further information, restrict a Conga’s visibility, remove a Conga or related content, limit invitations or further sharing, disable messaging, suspend or restrict accounts, or take any other action we reasonably consider necessary for safety, legal, security, or regulatory reasons — including without prior notice where we reasonably believe urgent action is required. This is a discretionary right, not an undertaking to monitor, prevent, or resolve every potential problem.

Where legally permitted or required, we may preserve and disclose relevant information — including Conga Creator details, account information, Conga data, communications, or location records — to police, emergency services, regulators, courts, or other competent authorities, subject to applicable data protection law and our Privacy Policy.

14.Sponsored Content and Congas We Organise

Paid placement, promotion, advertising, or subscription status does not transfer operational responsibility for a Conga to us and is not a safety guarantee. We are not the Conga Creator of any Conga on the platform unless we expressly identify it as one we have organised ourselves. Where we do organise a Conga ourselves, separate terms specific to that Conga will apply in addition to these Terms.

15.Subscriptions and Payment

Conga offers optional paid subscriptions that provide additional functionality, which may include an increased ability to plan Congas in advance, a greater number of public Congas, access to the Fans feature, and other benefits. Full details of current subscription tiers and their features are available within the app and may change from time to time.

Subscriptions are billed through the Apple App Store or Google Play. Billing terms, cancellation rights, and refund policies are governed by the relevant app store’s terms.

Conga does not store full payment card details. See our Privacy Policy for details of what subscription information we receive.

Conga may from time to time offer promotional pricing or free trials of a subscription. The terms of any such offer, including duration, eligibility, and what happens when it ends, will be set out at the time the offer is made available.

Where applicable, subscriptions renew automatically until cancelled. Cancelling a subscription prevents future renewal but does not end your current paid period early or entitle you to a refund for that period, except as required by law or the relevant app store’s policies.

If we make material changes to what is included in a paid subscription tier, we will give reasonable notice before those changes take effect. Where practical, material reductions to a tier you are already subscribed to will not apply until your next renewal.

If the price of a subscription changes, the new price will apply from a future renewal, and you will be given notice as required by the relevant app store and applicable law.

16.Intellectual Property

Conga and its content, features, and functionality — including but not limited to the Conga name, logo, and platform design — are the property of Conga Media Limited and protected by applicable intellectual property laws. Using the app does not grant you any rights of ownership in our intellectual property, whether temporarily (for the duration of your account) or permanently. You must not reproduce, distribute, or create derivative works from any part of the Conga platform without our prior written consent.

If you believe content on Conga infringes your intellectual property rights, please send a notice to legal@congamedia.com identifying the content, your rights in it, and your contact details. We will review valid notices and may remove or restrict access to the content in question.

17.Disclaimer and Limitation of Liability

The Conga app is provided “as is” and “as available.” We make no warranties, express or implied, regarding the reliability, accuracy, or fitness for a particular purpose of the service.

To the fullest extent permitted by applicable law, Conga’s liability to you for any loss or damage arising from your use of the service is limited to the greater of (a) the total fees you have paid to Conga in the 12 months preceding the event giving rise to the claim, or (b) £250.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

Nothing in these Terms affects your statutory rights as a consumer under UK law, including under the Consumer Rights Act 2015.

Without limiting the general disclaimer above, and subject always to the liabilities that cannot be excluded or limited as set out above, we are not liable for: injury, loss, or damage arising at a third-party Conga; the acts or omissions of Conga Creators, venues, attendees, or other third parties; cancellation, postponement, or relocation of a Conga; inaccurate Conga information; lost tickets, travel, or accommodation costs; property loss or theft; the conduct of other users; adverse weather or local conditions; or the failure of external ticketing, transport, or mapping services. The only exception to this is where the loss was caused by negligence on Conga’s part while acting as the organiser of the relevant Conga.

18.Third Party Services

Conga integrates with third-party services including maps, analytics, and payment providers. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the practices or content of third-party services.

Where Conga links you to a venue, ticketing company, transport provider, or other external service, that service is supplied by the relevant third party under its own terms — including ticket fulfilment, refunds, venue access, and transport arrangements. We are not responsible for the acts, omissions, or failures of these third parties. We will aim to make it reasonably clear within the app when you are leaving Conga or entering into an arrangement with a third-party provider.

19.Changes to the Service and these Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email before the changes take effect. Your continued use of Conga after the changes take effect constitutes your acceptance of the updated Terms. Any changes affecting paid subscriptions are also subject to Section 15.

We may also modify, suspend, or discontinue any aspect of the service at any time, with reasonable notice where possible.

20.Termination

You may close your account at any time through the app settings. We may suspend or terminate your account, or restrict your access to any part of the Service, on the grounds set out in Section 13, to comply with legal or regulatory obligations, or if you otherwise breach these Terms — with or without notice, depending on the severity of the issue.

On termination, your right to use Conga ends immediately. Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will continue to apply.

21.General

Assignment: You may not transfer your rights or obligations under these Terms; we may assign or transfer ours to an affiliate or in connection with a merger, acquisition, or sale of assets.

Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

Waiver: Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

Entire Agreement: These Terms, together with our Privacy Policy and any Community Guidelines, constitute the entire agreement between you and Conga regarding your use of the service.

Notices: We may give you notice via the app, email, or by posting on our website. You may give us notice at legal@congamedia.com.

22.Governing Law

These Terms are governed by the laws of England and Wales. If you are a consumer, you will also benefit from any mandatory protections afforded to you by the law of the country in which you live. Subject to those protections, any disputes arising from these Terms or your use of Conga will be subject to the courts of England and Wales.
